Photography Contract FAQ
What should a photography contract include?
A photography contract should include: shoot date, time, and location; the number of edited images to be delivered; the delivery timeline and format; licensing terms (personal vs. commercial use); total fee and deposit amount; cancellation and rescheduling policy; liability limitations; and whether the photographer may use images in their portfolio.
Who owns the photos after a shoot?
By default, the photographer retains copyright over their images. A contract can grant the client a license to use the images (e.g., for personal or commercial use) without transferring copyright. Full copyright transfer requires an explicit written assignment, typically at a significantly higher fee.
Should a photographer require a deposit?
Yes. A non-refundable retainer (deposit) of 25-50% is standard in the industry. It secures the date, compensates the photographer for blocked calendar time, and covers preparation costs if the client cancels last-minute.
Is this photography contract template free?
Yes, completely free — no account, no watermark, no time limit. Edit and download as many photography contracts as you need.
What happens if the photographer can't make it?
Your contract should specify a force majeure clause and what happens if the photographer is incapacitated. Most professional photographers have a network of backup photographers they can refer. The contract should address full refund or rebooking rights if the photographer cannot fulfill the booking.
